Form of indemnity
A form of indemnity, or hold harmless agreement (HHA), is a legally binding contract that protects one party from losses, damages, or liabilities caused by specific actions or events. Businesses use it to protect themselves from liability when providing services.
Travel and hospitality companies use indemnity forms in different ways. For example, tour operators require participants to sign waivers before joining adventure activities. Car rental companies rely on loss damage waivers (LDW) and collision damage waivers (CDW) to shield themselves from financial responsibilities in the event of an accident.
The structure of these agreements may vary based on the scope of protection, type of service, and legal requirements in each region. Some contracts offer broad protection, covering nearly all liabilities, while others are more limited and apply only to specific scenarios.
